In California, child support is determined by a set of specific guidelines. With dedicated experience since 1989 working with Riverside families, we understand the determining factors, and we can help you figure out what you can expect from your child support plan.
Today, complex computer programs are used to analyze the various factors and determine a plan. In Riverside County, the courts use a program called X-Spouse. Many of the surrounding counties use a program called DissoMaster. We have experience using both programs, which each take into account the following factors:
- Income of the custodial parent
- Income of the non-custodial parent
- Amount of time the children spend with the non-custodial parent
The more time the non-custodial parent spends with their children, the less support they usually have to pay.
If you believe that your ex-spouse is working at a job in which they are not making what they could be making in order to pay less or receive more support, there are ways to mitigate this. The court will impute income to a parent, if they determine they are working less than they could in order to get a better child support plan. The courts take "ability to earn" under consideration, and most importantly, it is not in the best interest of your children. At Bratton & Bratton, we put children first.
Child Support Modifications
If a significant change to your financial situation or parenting plan took place since your original settlement, you may be able to obtain a modification to your child support order. You deserve to have an order that accurately reflects your current situation. From job loss to remarriage, child support modifications can be based on changes by you and/or your co-parent.
